Berks County Has a Special ARD Program For First Time Offenders
The Accelerated Rehabilitative Disposition program ("ARD"), is more focused on rehabilitation than penalizing offenders. The ARD program requires such things as probation, fines, an evaluation for drug and alcohol problems, and community service.
Successful completion of the program will benefit first time offenders in several ways including the dismissal and expungement of the charges, and no criminal record for the DUI.
How It Works
The attorney representing the driver will try to work with the District Attorney to try to have the driver admitted into the ARD program. If admitted, the driver will appear in court with the attorney where the DA will move to have the judge accept the person into the program. The person can expect to be in court with a number of other people who are being accepted into the program on the same date.
Are There Programs for a Second or Third Offense in Berks County?
Yes. The County offers the STOP program for Second Offenses and a Treatment program for Third Offenses, both of which might provide a way to avoid the mandatory Penalties associated with each.
