Can the Test Results be Used Against Me?
Maybe. First the District Attorney is obligated to prove that a number of matters required by the Commonwealth. For instance, there are procedural requirements for police officers. These include such things as a minimum observation period of 20-minutes, test protocols such as administering the proper number of tests, and having a valid basis for pulling over the driver (a valid reason for the stop) .
